01About these terms
These terms are between you and Bramble Labs Inc. and apply to Fern’s app, website, beta, and related services. By using them, you agree to these terms. You must be legally able to accept them and obtain parental or guardian authorization where your local law requires it.
The Privacy policy describes information handling. These terms do not replace separately required consent or an applicable app-store licence.
02How capsules work
Fern lets a group contribute photos to a capsule during its collection period and view them after the chosen reveal time. Contributed photos stay hidden from members, including the host, until reveal; a separately chosen cover may be visible earlier. Membership and feature permissions determine available actions.
Do not treat a reveal schedule as a guarantee of uninterrupted access or a precise delivery time for notifications. Processing, connectivity, device settings, or service interruptions can delay availability. Keep your own copies of irreplaceable photos.
03Accounts and invitations
Provide accurate account information, protect your sign-in, and use invitations only with appropriate permission. Do not impersonate others or invite people through spam. You are responsible for activity you authorize and should tell us about suspected unauthorized use.
Hosts and members must respect other people’s privacy and rights. A private group is not permission to upload unlawful content or publish someone’s image without required consent.
04Your photos and content
You retain ownership of your photos and other content, subject to others’ rights. You give Fern a non-exclusive, worldwide, royalty-free permission to store, copy, process, resize, transmit, and display it as necessary to provide the features you choose, including through service providers and to authorized capsule members.
This permission does not transfer ownership or authorize unrelated advertising use. You must have the rights and permissions needed for the content you contribute. The permission lasts as needed to operate the service and handle retention under the Privacy policy.
After reveal, members may save photos. Deleting content or an account cannot recall independent copies, screenshots, or content shared outside Fern. Share only what you are comfortable making available to the members you invite.
05Respectful and lawful use
Do not use Fern to harass, threaten, exploit, impersonate, or violate another person’s privacy. Do not upload illegal content, child sexual exploitation material, non-consensual intimate imagery, malware, or content that infringes another person’s rights. Do not bypass membership or reveal restrictions, harvest information without authority, or disrupt the service.
Report abuse, privacy concerns, or rights-holder requests to fern@mawa.dev with the relevant context. Avoid sending unnecessary sensitive images. We may review reported activity, limit content or access, and act on lawful requests. Contact us if you believe an action was mistaken.
06Waitlist, beta, and availability
Fern is currently prerelease. Joining the waitlist is free, does not create an app account or subscription, and does not guarantee an invitation or launch date. Optional TestFlight interest is handled separately from launch-email preferences.
Beta features may be incomplete, change, or be withdrawn. Access may be limited by device, platform, region, build, or invitation. Apple’s TestFlight terms and applicable platform rules also apply. Website previews are illustrative and do not create a real capsule.
Any future paid feature must show its price, billing interval, cancellation terms, and relevant purchase conditions before you buy. These terms do not themselves enroll you in a paid plan.
07Fern and third-party services
Fern’s branding, interface, and software remain protected by applicable intellectual-property rights. You may use the app and website as permitted by these terms and applicable app-store licences; you do not acquire our trademarks, software ownership, or other users’ content rights.
Authentication, email, notifications, and app distribution depend on third-party services. Their terms apply to their own services. Bramble Labs operates Fern; Apple and Google do not operate your capsules or provide Fern support under this agreement.
08Ending use and account requests
You can stop using Fern at any time and contact support for deletion or data assistance. Uninstalling does not delete a server account. Data handling and the current prerelease deletion process are described in the Privacy policy.
We may suspend or end access for material violations, security risks, or legal requirements, with notice and an opportunity to respond where appropriate. Urgent situations may require immediate action. Ownership, accrued obligations, and provisions that reasonably need to continue survive where lawful.
09Responsibility and legal rights
To the extent permitted by law, Fern is provided as available without guarantees of uninterrupted service, compatibility with every device, or recovery of every uploaded photo. We remain responsible for obligations and care required by applicable law.
To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, or independent third-party failures. This does not exclude liability that cannot lawfully be excluded, including fraud, intentional misconduct, or mandatory consumer protections. Nothing requires arbitration or takes away a legally guaranteed complaint or court remedy.
10Updates and contact
We may revise these terms as Fern develops and will provide notice or request renewed acceptance where required. If a provision is unenforceable, the rest continues to the extent lawful.
